These Terms of Service ("Terms") govern your access to and use of the virtual private network services, software applications, websites, and related services (collectively, the "Services") provided by BlackCobraVPN, operated by Defied Trust Digital Trading (FZCO), a company incorporated under the laws of the United Arab Emirates (“BlackCobra VPN," "we," "our," or “us").
By downloading, installing, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
Our privacy policy, available at Privacy Policy, and our Refund Policy, available at Refund Policy, are incorporated into these Terms by reference. You agree to comply with the provisions of these documents when using our Services.
You must be at least 16 years of age to use our Services. If you are under 18 years of age but at least 16 years old, you represent that you have the permission of a parent or legal guardian to use the Services, and your parent or legal guardian has reviewed and agrees to these Terms.
To use our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.
We offer various subscription plans for our Services. Details of our current subscription plans and pricing are available on our website. All subscription fees are stated in US dollars unless otherwise specified.
Payment for our Services can be made through various payment methods that we accept. You authorize us to charge the applicable subscription fees to your chosen payment method. All payment information will be handled in accordance with our Privacy Policy.
Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew for the same subscription period at the then-current price. By purchasing a subscription, you authorise us to automatically charge your payment method for each renewal period until you cancel.
We reserve the right to modify our subscription fees at any time with notice to our users. Any fee changes will take effect at the beginning of the next billing cycle. If you do not agree with a fee change, you may cancel your subscription before the beginning of the next billing cycle.
Subscription fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United Arab Emirates (federal or state) taxes based on our income.
You may cancel your subscription at any time by accessing your account settings or contacting our customer support. Please refer to our Refund Policy for information regarding refunds.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the BlackCobraVPN software applications ("Software") on devices that you own or control solely for personal, non-commercial purposes.
You agree not to, and you will not permit others to:
• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Software or make the Services available to any third party;
• Copy, modify, adapt, translate, make derivative works of, disassemble, decompile, reverse compile, reverse engineer, or attempt to derive the source code or underlying ideas or algorithms of any part of the Services, except to the extent allowed under applicable law;
• Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of BlackCobraVPN or its affiliates, partners, suppliers, or licensors;
• Use the Services to violate any applicable laws, rules, or regulations, or for any unlawful, harmful, or abusive purpose;
• Use the Services to infringe any patent, trademark, trade secret, copyright, right of publicity, or other right of any person or entity;
• Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein;
• Engage in reverse engineering or modify the Services in any unauthorized manner;
• Attempt to gain unauthorized access to the Services or related systems or networks;
• Use the Services for any purpose that violates the rights of third parties or causes damage to them;
• Use the Services to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature;
• Use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index any portion of the Services;
• Access the Services through any automated means or interface not provided or authorized by us; or
• Attempt to circumvent any technological protection or bypass any technological protection and measures or access controls within the Services.
You agree not to use our Services to:
• Engage in illegal activities or to promote illegal activities;
• Transmit or distribute material that is harmful, obscene, defamatory, infringing, invasive of privacy, or otherwise objectionable;
• Engage in activities that may disrupt or interfere with the Services or networks connected to the Services;
• Transmit or distribute unsolicited commercial or bulk email ("spam");
• Collect or harvest any personally identifiable information from other users of the Services;
• Impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
• Engage in any automated use of the system, such as scripts to send comments or messages;
• Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services;
• Attempt to bypass any measures we have put in place to prevent or restrict access to the Services;
• Engage in unauthorized access to, use of, or tampering with other users' accounts;
• The Services are strictly reserved for lawful civilian use. Using BlackCobraVPN in connection with military activities, arms development, ordnance design, or weapons systems operations is expressly forbidden and grounds for immediate service termination.
We implement technical, administrative, and physical safeguards to protect our Services, but no security measures are perfect. You agree not to test the vulnerability of our systems or networks or breach any security or authentication measures.
You agree to comply with all applicable export control laws and sanctions programs. You represent and warrant that you are not located in, and will not use the Services from, a country subject to UAE government embargo or that has been designated as a "terrorist supporting" country, and that you are not listed on any UAE government restricted parties list.
BlackCobraVPN may include certain open-source code components with the Software. These components are distributed under the terms of their respective open-source licenses. Your receipt and use of such open-source code components neither expands nor restricts your rights or obligations as defined by the applicable open-source licenses. Copies of the relevant open-source licenses for components included with the Software are either included with or referenced in the Software's documentation. BlackCobraVPN respects the intellectual property rights of open-source contributors and encourages users to familiarize themselves with these licenses.
You may use the Software solely to access the Services. A computer, mobile phone or device, or other equipment enabled to access the Internet (a “Device”) is required to utilize the Services. It is therefore your responsibility to ensure that you have, at all times, an active and stable internet connection. You are solely responsible for ensuring that your Device is sufficient and compatible for use with the Service and complies with all System Requirements. The speed and quality of the Software and Services may vary and are subject to unavailability, including emergencies, third-party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and maintenance and repair, and may be interrupted, refused, limited or curtailed.
Upon expiration or any termination of these Terms, you must stop using the Services, delete or destroy all copies of the Software, from all Devices, and cease use, return, or destroy any of Our Materials in your possession.
The Services, including but not limited to the software, website design, text, graphics, logos, trademarks, trade secrets, and all other content, features, and functionality (collectively, the “Intellectual Property”), are and will remain the exclusive property of BlackCobraVPN and its licensors. All rights, title, and interest in and to the Intellectual Property are protected by applicable copyright, trademark, patent, and other intellectual property laws of both the United Arab Emirates and foreign countries. Nothing in this Agreement grants you any right, title, or interest in the Services, except for the limited rights expressly granted to you in this Agreement.
If you provide any feedback, suggestions, ideas, improvements, or other contributions related to the Services (collectively, "Feedback"), you hereby grant BlackCobraVPN an unlimited, irrevocable, perpetual, sub-licensable, transferable, royalty-free, and worldwide license to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose, in any medium, now known or hereafter developed, without any obligation to provide compensation, attribution, or notification to you. You acknowledge that BlackCobraVPN is under no obligation to implement or use any of your Feedback, and you waive any rights to enforce any claims regarding your Feedback against BlackCobraVPN or its affiliates.
The trademarks, service marks, logos, and trade names of BlackCobraVPN, including but not limited to "BlackCobraVPN" and other marks displayed on the Services, are the exclusive property of BlackCobra VPN or its licensors and may not be used without prior written permission from BlackCobra VPN. All other trademarks, service marks, logos, and trade names appearing on the Services are the property of their respective owners.
The Services may contain links to third-party websites, services, or content that are not owned or controlled by BlackCobraVPN. We do not endorse or assume any responsibility for any such third-party sites, services, or content. If you access a third-party website, service, or content from the Services, you do so at your own risk and understand that these Terms and our Privacy Policy do not apply to your use of such sites.
You may choose to enable, access, or use third-party applications, websites, or services that integrate with our Services ("Third-Party Applications"). By enabling Third-Party Applications, you acknowledge that we may transmit data relating to your account and use of the Services to these Third-Party Applications. Any use of a Third-Party Application is subject to the terms and conditions of the applicable third party.
Our Privacy Policy explains how we collect, use, and protect your personal information when you use our Services. By using our Services, you consent to our collection, use, and disclosure of information as described in our Privacy Policy.
We maintain a strict no-logs policy. We do not collect or store browsing history, traffic destination, data content, DNS queries, IP addresses, or any information that could be used to identify our users or their online activities.
We implement reasonable administrative, technical, and physical security measures to protect your information from unauthorized access, theft, and loss. However, no security system is impenetrable, and we cannot guarantee the security of our systems with absolute certainty.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BLACKCOBRA VPN OR THROUGH THE SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.
WITHOUT LIMITING THE FOREGOING, BLACKCOBRA VPN DOES NOT WARRANT THAT (I) THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; OR (IV) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.
BLACKCOBRA VPN DOES NOT WARRANT THAT THE SOFTWARE OR THE SERVICES WILL BE COMPATIBLE WITH ALL HARDWARE, SOFTWARE, OR NETWORK ENVIRONMENTS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLACKCOBRA VPN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF BLACKCOBRA VPN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
UNDER NO CIRCUMSTANCES WILL BLACKCOBRA VPN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO BLACKCOBRA VPN FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS LIMITATION OF LIABILITY WILL APPLY WHETHER THE CLAIMS ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR BLACKCOBRA VPN WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
IN NO EVENT SHALL BLACKCOBRA VPN BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH: (A) INTERRUPTIONS OR CESSATION OF THE SERVICES, (B) ANY FAILURE TO TRANSMIT OR STORE DATA, (C) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, OR (D) ANY LOSS OR DAMAGE TO YOUR DEVICE, COMPUTER, OR DATA.
You agree to defend, indemnify, and hold harmless BlackCobraVPN, its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, lawsuits, damages, losses, liabilities, costs, and expenses (including, without limitation, reasonable attorney's fees, expert fees, and court costs) arising out of or in connection with:
(a) Your use of the Services, including but not limited to any violation of the terms of this Agreement or any applicable laws, regulations, or third-party rights;
(b) Your breach of any representation, warranty, or covenant made under this Agreement;
(c) Any third-party claims arising out of or related to your content, actions, or conduct while using the Services;
(d) Your violation of the intellectual property rights or other rights of any third party, including any infringement or misappropriation of the intellectual property rights of BlackCobraVPN or its licensors;
(e) Your negligence or willful misconduct, or any other actions that may lead to liability under applicable law;
(f) Your failure to comply with any local, state, national, or international laws, regulations, or orders while using the Services; and
(g) Any other matter related to or arising from your use of the Services.
BlackCobra VPN reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with BlackCobraVPN in asserting any available defenses. You will not settle any claim without BlackCobraVPN’s prior written consent, which will not be unreasonably withheld.
This indemnification provision shall survive the termination of this Agreement and your use of the Services.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof, or the use of the Services, shall be resolved exclusively through binding arbitration in the United Arab Emirates. Such arbitration shall be conducted in accordance with the rules of the Dubai International Arbitration Centre (DIAC) or another mutually agreed arbitration center within the UAE. The arbitration proceedings shall be held in Dubai, UAE, unless otherwise mutually agreed in writing. The language of arbitration shall be English. The arbitrator(s) shall apply the laws of the United Arab Emirates, as specified in Section 12.1 of these Terms. The award rendered by the arbitrator(s) shall be final and binding upon the parties.
Notwithstanding the foregoing, you or BlackCobra VPN may seek injunctive relief in a court of competent jurisdiction for any alleged violation of intellectual property rights or for matters requiring immediate resolution.
The parties will bear their own costs of arbitration, except that BlackCobra VPN will pay the filing fees if you are the prevailing party.
You and BlackCobra VPN agree that any arbitration shall be conducted on an individual basis only, and not in a class, consolidated, or representative action. You agree that you will not seek to participate in any class action lawsuit or class-wide arbitration against BlackCobraVPN.
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of laws principles.
You agree that any legal action or proceeding arising out of or in connection with these Terms or the use of the Services shall be brought exclusively in the competent courts located in the United Arab Emirates. You consent to the personal jurisdiction of such courts and waive any objection to such jurisdiction or venue.
These Terms will remain in full force and effect while you use the Services. We may suspend or terminate your access to the Services at any time, with or without notice, if you violate any provision of these Terms.
You may terminate these Terms at any time by ceasing to use the Services and deleting your account.
Upon termination, you must immediately cease using the Services, uninstall the Software, and destroy all copies of the Software and any other materials related to the Services in your possession.
BlackCobra VPN shall not be held liable for any failure or delay in performance under these Terms due to any cause beyond its reasonable control, including but not limited to, acts of God, natural disasters, pandemics, power failures, internet service interruptions, or any other event beyond BlackCobra VPN's reasonable control.
If any provision of these Terms is held to be invalid, illegal, or unenforceable in any jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the intent of the original provision.
These Terms, along with our Privacy Policy, Refund Policy, and any other legal notices published on our Services, constitute the entire agreement between you and BlackCobraVPN regarding the use of the Services. If any part of this Agreement is found to be invalid, the rest will remain in effect.
We may update these Terms at any time. When we make changes to these Terms, we will update the effective date at the top of this page. We encourage you to review these Terms periodically. By continuing to use the Services after the changes are made, you accept and agree to the updated Terms.
